Wendy's Closure Was ADA Related

I bumped into a fellow on Saturday who was in the position to know. He told me the closure of Eureka's Wendy's restaurant was, indeed, because of the Americans with Disabilities Act. He didn't know if local scuzbag, Jason Singleton, was involved.

There were a number of supposed violations and the chain's management decided it wasn't worth the expense to make the corrections so they shut the place down. Another one bites the dust because of the ADA.

On a related note, looks like Senator Dianne Feinstein is using the issue to get her name in the paper in an election year. She's made some waves so there might be some legislative resolution to the ADA issue on the horizon.

Mikes was attacked for ADA reasons. That is why they are only take out now.

God forbid a corporation comply with the the law. 25 years is not nearly enough time.

Ah good, someone who has no business sense, dictating to businesses what they should do.

The ADA requires are a confusing mess.

With the cost of permits, labor, etc, the low profitability meant it was not worth remodeling the store. Keep in mind, remodeling would require closing the store down, further hurting profitability.

'Supposed violations' sounds suspiciously like 'violations.' Fred, you keep using that word. It doesn't mean what you seem to think it means.

What the ADA requires is not 'a confusing mess.' The regulations are quite explicit. In this day an age, especially for a fast food building, I can't imagine one not being ADA compliant. It's a civil rights issue.

Wow. I had no idea. At least they found a way around it, albeit still taking a big hit. Shame that they had to. It's too bad more businesses can't find work- arounds.

It seems even your hero, Dianne Feinstein, sees a problem with ADA.

As for me, I'm pretty much a believer in having the ADA scrapped altogether, at least for existing buildings and business. Either that, or just make it an advisory type thing where they could point out problems and give businesses the option of correcting violations should they choose. No force involved.

Some say ADA should only apply to new construction. That makes more sense than attacking decades old businesses and buildings. I'll leave that for others to argue.

I don't believe civil rights should allow any person to compel a business to do business with them.

The vast majority of businesses want to get business from as many people as they can. If someone or some business doesn't want to make their building accessible to anyone, for whatever reason, that should be their choice. It's called freedom of association.

You are right. Wendy's has not made any where near enough money to bring their buildings into compliance.

It would be far too great a burden to use their average $500,000,000 annual profits to invest in modernizing buildings. It is much better idea to burden the disabled with unequal access.

Funny that it's often disabled folks that are used by lawyers to find violations. They make it into the building fine, then go around taking measurements to find anything wrong- a serving counter that's a half inch too high, or some such.

Oh, and remember nobody can go to Eureka's Wendy's now. Not even the disabled. The complaints against Wendy's sure helped the disabled, didn't they?

At least we're all equal now at Wendy's.

I agree, Wendy's is closed because they could not comply with a twenty- five year old disability access law signed into law by George Bush.

Wendy's, as evidenced by their annual corporate profit could clearly could not afford the outrages construction costs in Humboldt County.

It's wasn't worth them to put a bunch of money into a branch that doesn't bring in very much money, most likely.

But you got your way. The disabled don't have to worry about all the hurdles they suffered at Wendy's anymore.

Fred you must understand how franchises work?
This was not a "branch" of Wendy's. The owner chose not to re invest his earnings into his business.

My question is why didn't he move Wendy's to the ADA compliant empty jack in the box building?
