Justice Scalia Dies

Supreme Court Justice Antonin Scalia died yesterday setting off the speculation about how he'll be replaced and by whom. It's a partisan issue with Eric Kirk seeming to be glad he's dead although he doesn't give specifics as to why.

I wish I'd kept track of that article from Reason magazine a few years ago where the writer made the case that labels of left or right leaning regarding SCOTUS justices don't always hold true and that they'll often rule contrary to what one might expect. Bush appointee, John(?) Roberts being one example that comes to mind when he ruled in favor of Obamacare some time ago.

So. I'm not too concerned about who ends up being the replacement, although I'm sure the partisan discussion over that speculation will take its toll on me. All I feel for sure is that replacement will gradually give more and more power to the federal government as the other justices seem to have done over time. Not something I look forward to either way.

Agreed Fred, your logic is spot on. Scalia passing away makes zero difference if the replacement is a Scab employee of government.

It is soooo funny how conservatives claim that they don't want to give power to the federal government. This comes out of the hypocritical mouths of men who want the government to limit Healthcare for women, who encourage government to waste our money on endless, useless wars,more militant policing, more INCARCERATION!!!! How can you claim to hate government and then want government to lock up everyone you don't agree with? Ever read the political blogs? It's very common practice for conservatives to agrue for throwing detractors into FEDERAL PRISON.

Face it, the only government that conservatives wants is one where no brown or black people are included. That is the ONLY time conservatives want to limit government.

Drive through rich areas and see how nice the roads are, how clean and available public bathrooms and clean drinking water are. Yet, it's the upper class conservatives who claim that everyone else is spending the money. As they live in luxury and laugh at the poor rubes too stupid to be like them.

You live in a country with the HIGHEST INCARCERATION rate in the entire world and you have the balls to claim that this country doesn't give power to the feds? You are either very very high, or really haven't thought this one out very deeply.

To be fair, Scalia did have the balls to come out and say that he was against "racial entitlements". The used that exact phrase. The American people are just so clueless or racist that they agreed and Scalia was able to continue on with this nonsense.

One of the best Justices of all time, actually read the constitution as it was written. The constitution was not meant to be changed with the eb and flo of our country. It was meant to make the eb and flo. Biggest thing wrong with this country is the way we have slowly got away from the constitution. It worked for many years as written once they started changing it the country started changing and not for the better.Then you have people like anonymous making stupid uneducated comment like" all the conservatives want is a country without browns and black" how ignorant can you be. she obviously does not know a thing about history like the fact that not one democrat voted to end slavery it was all republicans who ended it. And she can keep her Those were ther democratsd of today because know matter how many times you liberals repeat your lie it does not make it true. there the same democrats of them. Longest sitting senator in america was DEMOCRAT robert bird who was a KKK member and recruiter. Or how about the fact of the only african american on supreme court is a republican appointment, Clarence Thomas.Or the fact MLK was a republican. Then we get to womens healthcare. SO because the republicans dont want women mutilating babies somehow they are limiting womens healthcare.CLUELESS you are. hen we get to incarceration and the highest incarciration. Well brain child if you actually researched the facts. The incarceration rate has got to where it is because of DEMoCRAT Bill clintons(womenizer,sexual deviant) policies of 3 strikes.hey and dont forget your boy bill also passed DOnt ask dont tell SO anonymous you might want to learn a little history because your B.S was just line by line proven to be nothing but liberal Horsesh*t. Rest in piece justice Scalia thank you for keeping us together aslong as you have. The country will never be the same and now we will see the just how bad it can get.

If only people would step away from their indoctrinations and reeducate themselves. I am constantly amazed at the accusations & the complete ignorance of the general population today. They fight over issues that are not issues. They are agendas.
If every person would just take the time to read the constitution, educate themselves of the difference between rights & privileges, they would then know they are arguing over agendas, not rights.
But, gosh, a pamphlet is a long read. Smh

Um...the rights are a bit vague, wouldn't you say? Especially since millions and millions of americans(conservatices) approve of government beaurocrats having the power to search my through my medicine cabinet and throw me in jail if they don't like what they see. This is a CLEAR violation of the Constitution, yet conservatives will not give up the power of the government to oppress the people in this way.

10:09, no, you don't. We loose our right to self govern when or if we intentionally hurt another person.
Babies in the womb, have heart beats, are fed through the cord, are who is comprised of living cells. The constitution provides for the right to seek healthcare, it does not provide permission to force healthcare or murder on the people.
The law was changed in the 1960's, to allow preventative pregnancy through contraceptives, and to provide safe environments between doctor & patient, in life saving procedures.
Nowhere does the constitution allow abortion as a contraceptive method. Nowhere does the constitution say we are to be forced to pay for others food, shelter, healthcare, education, and so on. People are free to help where they wish to help. If you can't afford a contraceptive, you have the right to ask for help in achieving your goals, but you do not have the right to force others to help you achieve your goals.

10:17, yes, you are correct, that is unconstitutional. Ron Paul stood up against such intrusions & atrocities, so they pounced on him. Had the people of followed the constitution instead of the paid media, we would not be in this boat today. The fact we even have "parties" is unconstitutional. The framers warned against this. The framers set it up so that elected officials are elected to protect the constitution, not change, shred, update, or ignore it. If a candidate is not in keeping with the constitution, they are considered a threat to the USA. The same for the elected. It was all outlined for protecting, through checks & balances.
The federalist papers, anti-federalist's papers, Declaration of Independence, & the constitution all describe why & what the framer's original intent was. No matter how much the nation changes, the constitution will forever be the only supreme law of the land. It's up to the people to know this, understand this, & petitition for this.

My goals? To have sex as much as possible and not have babies. But thats not the issue here. I can afford my birth control.

The need for birth control pills, condoms, morning after pils, early term abortions, ect exists where people can't afford them. Because, beleive it or not, we are all human and we love sex. Day and night. On the hood of a car or on the beach. We love to do it like rabbits. We have 7 billion people already. We don't need to keep breeding like rabbits.

Stop with the drama queen bit about babies in the womb. You are a prude or an authoritarian, not a baby lover. That's a load of garbabge

He dissented on a case that gave the feds power to enforce pot laws in states that approved medical marijuana. Big deal. Much more of a "state's right" defender than personal liberty, I'm sorry to break it to ya.

He was recommended by Edwin Meese, the guy who STARTED the drug war and approved by Reagan who FUNDED the drug war. He was no friend of freedom loving americans.

Passing 2nd grade science and knowing where babies come from is a big accomplishment in Humboldt County! I'm amazed at the lack of education with many of the good old boys here.

I got into a discussion the other day with a guy who claimed that education was the downfall of America! Not lack of education. Education.

This is from a guy whos daddy made sure he never had to perform a hard days in his entire life and could have easily gone on to get himself educated. Instead he stays in humboldt and plays with his inherited money while sitting in coffee shops pretending he worked for it all....

11:59, Believe it or not, the state's constitution is 2nd to the nation's constitution. They compliment each other, not contradict each other. The state sends their representatives to relay issues or solutions, the voice of the people. Well, it's supposed to work that way. Unfortunately, in today's whacked out political scene, the people are TOLD what the representatives are doing, like it or not, & if you don't like it, you are considered a dissenter.
Neither the state nor the federal government have the power to govern individuals, unless they steal the power, which is exactly what both have done. Scalia did his best to shy America away from abuses of power. He wasn't perfect, no human is. But he did try.
