Probation For Robbery?

Is there a problem here?

I'm reading
this story in the Eureka Reporter about some arrests that were made recently. One of the arrests was that of Jacob Gabriel of Eureka. They arrest him for a couple robberies and attempted robbery earlier this month.

Yet the Reporter notes:
At the time of his arrest, police said Gabriel was on active felony probation for robbing U.S. Bank in Henderson Center last year.

He was convicted for robbing a bank last year and he's out on probation already? Is this one of those Gallegos plea bargains I keep hearing about?

Yes it is Fred. This is what the cops, probation officers and Dikeman kept telling folks before the election.

Probation for rapists.

Probation for child molester.

probation for everything!

Who was the assigned deputy DA
What charges were originally filed
What was the original sentencing
proposal by the DA, how did the
case get from filing as a felony to probation?

You can file a state foia request with the da's office to look at any closed file and get that procedural information, and the police reports. might make an amusing hobby. I think its
california gov't code beginning at 6254. would be even more interesting if the da doesnt want you to see the file, and stalls the request. i don't think there's much reason to deny public access to closed files. the probation report is only available for a limited period of time, not sure how long.

Probation for everything ? Sad but true, with the exception of murder! Probation probation probation !!!! And that trend will continue and will get worse.

How would a regular citizen file a "Foia" request ?

I remember about twenty years ago a citizens group in Orange County started a court watchers group, where retired people sat in court and followed cases and dispositions. There was a lady, or small group, that did that in Humboldt County around 20 years ago. I don't know who could or would form such a group, formal or informal, but I think it would be enlightening for everyday citizens to see how cases are dismissed or disposed of in the Humboldt County Courts!

Wow, that would be awesome if one or more of you got the information on the case(s) of Jacob Gabriel and then blogged on that. Opinions based on research are so much more interesting and meaningful than opinions based on...what are you people (particularly you anonymous people) basing your opinions on? Gallegos gives probation for everything eh? Got any numbers? Got any comparisons to numbers of other counties?

What makes Fred classier than you clowns (me included) is that he offers links to something he's read, and his opinion on the article. He's not asserting that he is right and is open to other viewpoints.

But alas, I'm too busy or lazy or sometimes just plum crazy to do any foot work myself.

Go on line and find Cal Gov code section 6254 and the sections after it. You can read how to submit a request citing those laws to the DA and or the cops. they have to respond.

you can go to the court clerk's office and ask to see the courts file.

hearldo and eric have been kind of quiet since the Coroners inquest didn't go as they hoped (or how I think they hoped it would have gone).

Wonder when Gag's is going to issue his ruling on the shooting?

Guess he will use the murder case he's on now as the excuse for the delay! IT's not like there's any new information.

Those guys made such a big deal about it and now nothing! Whimps.
